JUSTICE SANJAY PRIYA ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bhawanipur P.S. Case No. 30 of 2013 instituted for the offence under Sections 147, 148, 149, 307, 379, 436 and 302 of the Indian Penal Code. In the written report there is specific allegation against the petitioner that he along with other accused persons assaulted the son of the informant on account of which he died. Case diary has been received.

Learned A.P.P. has submitted that I.O. has filed petition in court below for issuance of process under Sections 82 and 83 Cr. P.C. against the petitioner.

From the order sheet it appears that the instant anticipatory bail application has been filed in the year 2014 and

Patna High Court Cr.Misc. No.29892 of 2014 (9) dt.04-01-2018 2/2 petitioner has not surrendered in the court below till date. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
