Mr.Manoj Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-04-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Sections 143, 341, 342, 323, 307 and 302 of the Indian Penal Code, registered in connection with Athmalgola P.S.Case No.185 of 2019.

Pappu Ram is the informant of the case. He alleged that that co-accused Suraj Singh, Golu Kumar, Ankul Kumar and Ravi Kumar with 3-4 unknown persons came by vehicle which injured the toe of Golu Ram, the son of the informant. On protest, the accused persons assaulted him with intent to kill. Co-accused Suraj Kumar and Ankul Kumar strangulated Golu Ram to death.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.33471 of 2021(2) dt.01-04-2022 2/2 that the petitioner is not named in the FIR and on similar footing co-accused Shivam Kumar has been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 07.04.2021 in Cr.Misc. No. 36108 of 2020.

Considering the above-mentioned facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, Patna in connection with Athmalgola P. S. Case No.185 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
