The petitioner has filed the present petition under Section 482 of the Cr.P.C for amalgamation of the FIR of Saraiya P.S. Case No. 218 of 2013, registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act pending in the Court of S.D.J.M., (West), Muzaffarpur with Complaint Case No.C-1561 of 2011 instituted for the offences punishable under Sections 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act pending in the court of S.D.J.M. (Sadar),
Patna High Court Cr.Misc. No.42310 of 2014(3) dt.11-10-2017 2/3 East Champaran at Motihari.
Notices were issued to the Wife-Opposite Party No. 2, and thereafter she has appeared through her counsel. Thereafter on the joint prayer of the parties, the matter was referred to the Mediation and Conciliation Centre of Patna High Court, for settlement of the dispute between the parties and the Mediation and Conciliation Centre of Patna High Court, in its report dated 23.11.20105 has informed this Court that the matter has been compromised between the parties and has prayed to quash the criminal case pending before the court of Muzaffarpur and East Champaran at Motihari.
Considering the aforementioned facts and circumstances of the present case and also in view of the fact that the mater has been amicably settled between the parties and settlement has been reported by the Mediation and Conciliation Centre of Patna High Court in its report dated 23.11.2015, sent to this Court, the Saraiya P.S. Case No. 218 of 2013 registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act pending in the Court of S.D.J.M., (West), Muzaffarpur and Complaint Case No.
Patna High Court Cr.Misc. No.42310 of 2014(3) dt.11-10-2017 3/3 Section 3/4 of the Dowry Prohibition Act pending in the court of S.D.J.M. (Sadar), East Champaran at Motihari, are quashed. This petition is allowed.
