JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Garkha P.S. Case No. 141 of 2017, registered under Sections 341, 323, 324, 307, 427, 504 and 506/34 of the Indian Penal Code, pending in the court of A.C.J.M.-V, Saran at Chapra. The accusation is that while the informant was in the market at about 6.15 P.M. he came to know that five persons named in the F.I.R. including the petitioner pelting bricks at his house, on which, he reached at his house then found that petitioner armed axe and others having Dabia and bamboo came there. At that time, petition gave axe blow at the head of the informant, on which, he fell down then Chinta Devi started to cause assault

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
