This application is for grant of anticipatory bail for the offence under Sections 307 and other Sections of the Indian Penal Code as well as Section 27 of the Arms Act.

The allegation against the petitioners is that they are named in the FIR.

It has been submitted on behalf of the petitioners that even from perusal of the case diary, it appears that there is omnibus allegation against the petitioners and the allegation of assault is against the other accused.

It has further been submitted that the FIR itself shows

Patna High Court Cr.Misc. No.52908 of 2016 (2) dt.21-12-2016 2/2 that there is a land dispute between them from before as well as there case and counter case over the matter of title suit between the parties, which will appears from Annexure- 4, 5, 6 and the application.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that there are case and counter case over the matter of title suit, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Khagaria in connection with Chautham P.S.Case No.101 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
