JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

Petitioner is not named in the first information report and the impugned order goes to show that the name of this petitioner came in confessional statement of co-accused Lakhan Ram who has already been granted privilege of bail by a coordinate bench of this court vide order dated 01.11.2018 passed in Cr. Misc. No. 58752 of 2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, taking note of this fact that

No.23893 of 2019(2) dt.15-04-2019 2/2 the petitioner does not have any criminal antecedent and is languishing in jail custody since 17.01.2019, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria (R.S.) P. S. Case No. 30 of 2018.
