The present restoration application has been filed to restore Cr. Misc. No. 40193 of 2016, which was dismissed on 08.11.2016. However, on 30.11.2016, notices were filed in pursuance to the order passed in the said Cr. Misc. Learned counsel for the petitioner submits that due to wrong calculation, notices were filed on 30.11.2016. Under such circumstances, Cr. Misc. No. 40193 of 2016 is restored to its original file and notice filed on 30.11.206 may be used by the office.
This application is accordingly allowed.
