JUSTICE SAMARENDRA PRATAP SINGH ORAL JUDGMENT Date: 12-04-2016 The petitioner was engaged as Anganwari Sahaika at Anganwari Center no. 98, Hasanpura Parnadi under Chilbili block Phulwarisharif, district Patna. Her service was terminated vide order, dated 28.6.2012, passed in Anganwari Case no. 170 of 2012, by the District Programme Officer, Patna which was upheld in appeal by the District Collector. Termination order was passed on 2 grounds. Firstly, as per quality of food, petitioner's center was accredited Grade E on 3.9.2011. Subsequently, in course of inspection on 30.5.2012, she was found absent from the center. The petitioner in her explanation submitted that at the time of inspection she had just left for house, to see her ailing son.
Patna High Court CWJC No.18248 of 2013 dt.12-04-2016 2/2 Counsel for the State submits that there is provision of further appeal before the Director I.C.D.S., (Integrated Child Development Scheme), Government Of Bihar, Patna (respondent no.2).
Without going into the merits of the case, this writ petition is disposed of with liberty to the petitioner to file an appeal before the Director I.C.D.S., (Integrated Child Development Scheme), Government Of Bihar, Patna (respondent no.2). In case, such appeal is filed, the same would be disposed of by respondent no.2 within a period of three months after condoning the delay as the petitioner was pursuing the remedy before this Court. .
