====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2020 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Sessions Trial No. 159 of 2019/562 of 2019, arising out of Konch P.S. Case No. 132 of 2020, registered for the offence under Sections 304(B)/34 of the Indian Penal Code.

As per the prosecution case, the sister of the informant was married with petitioner in the year 2016 and it is alleged that she was killed by this petitioner and his other family members for dowry.

It is submitted on behalf of petitioner that petitioner happens to be husband of the deceased and he never made any demand of dowry. It is further submitted that it is case of suicide, which will be apparent from the post-mortem report,

Patna High Court CR. MISC. No.26691 of 2020(3) dt.01-12-2020 2/2 wherein, the doctor has found the cause of death is Asphyxia due to hanging. The petitioner is in custody since 25-05-2019. However, counsel for the State vehemently opposed the bail application and submitted that petitioner is husband of the deceased and there is specific allegation of demand of dowry against him and death of the deceased has occurred in her matrimonial home within seven years of her marriage. Considering the aforesaid facts and circumstances, the bail application of petitioner is rejected.
