Petitioner seeks regular bail in connection with Bidupur PS Case No. 286/2018 registered for the offence punishable under Sections 394, 302, 396 of the IPC. As per First Information Report, the informant was intercepted by two unknown miscreants who tried to snatch the bag from the informant and upon protest, the accused persons fired upon the informant due to which, he sustained fire-arm injuries and during course of treatment, the informant died. Learned counsel for the petitioner submits that during course of investigation one Deepak Kumar was arrested and on the basis of his confessional statement the name of petitioner
Patna High Court CR. MISC. No.36192 of 2021(3) dt.31-03-2022 2/3 and that of others has transpired. He further submits that even for the sake of argument the confessional statement of the coaccused, Deepak Kumar is taken into account, he stated that while snatching the bag of the informant, one Sonelal Sah @ Sonal Kumar had fired upon the informant. Learned counsel further submits that co-accused, persons, namely, Abhishek Kumar Singh vide Cr. Misc. No. 18476/2019, Deepak Kumar Singh vide Cr. Misc. No. 13408/2019 and Saurabh Kumar @ Lalu vide Cr. Misc. No. 11997/2021 have been granted bail by Co-ordinate Benches of this Court.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the co-accused persons have been granted bail by Co-ordinate Benches of this Court, petitioner is in custody since 12.11.2020, I am inclined to grant regular bail to the petitioner subject to the conditions that (1) both the bailors shall be residents of territorial jurisdiction of the court concerned and (2) petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
Accordingly, let the petitioner, VARUN KUMAR @ VARUN PASWAN be released on bail on furnishing bail bond
Patna High Court CR. MISC. No.36192 of 2021(3) dt.31-03-2022 3/3 of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur in connection with Bidupur PS Case No. 286/2018.
