2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 186, 353, 354, 332, 333, 427, 307, 504 of the Indian Penal Code.

3. Prosecution case in nutshell is that on the secret information, informant (a police official) raided the house of one Renu Devi and recovered 25 litres of illicit liquor and utensils used for preparing wine. It is further alleged

No.25336 of 2025(2) dt.02-05-2025 2/3 that while they were returning, petitioner along with several other accused persons attacked and assaulted them due to which some police personnel sustained injuries and vehicle was also damaged. They have also created hindrance in discharging the official duty of the informant.

4. It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have falsely been implicated in the present case. There is no specific allegation of assaulting against them rather the allegation levelled against them is general and omnibus. It is further submitted that petitioners have not been identified by the informant or any independent witness. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. From perusal of Impugned Order, it is evident that other coaccused persons have been granted bail. Moreover, the petitioners are languishing in

5. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Sherghati P.S. Case No. 131 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Sherghati, Gaya.
