JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Panapur P.S. Case No. 97/2016, instituted for the offences punishable under Sections 147, 148, 149, 436 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that on a bare perusal of the impugned order passed by the learned 1st Additional Sessions Judge, Chapra, it would appear that on perusal of the case diary the learned court below found that the description of place of occurrence has been mentioned therein, but the I.O. has not mentioned regarding the burnt of articles which falsify the

Patna High Court Cr.Misc. No.8876 of 2018 (2) dt.20-02-2018 2/2 case under Section 436 of the Indian Penal Code. It has further been submitted that these petitioners have got no criminal antecedent and no specific overt act has been alleged against the petitioners in the written complaint filed by the informant. Learned A.P.P. for the State is present.

Considering the fact that the I.O. has not noted the description of the burnt articles as has been observed by the learned 1st Additional Sessions Judge, Chapra and there is no specific allegation of committing any overt act against these petitioners, let the petitioners above named, in case of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Chapra in connection with Panapur P.S. Case No. 97/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J.) Rakhi U T
