JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-07-2023 Let the counter affidavit be taken on the record. Petitioner in the present case is seeking a writ in the nature of mandamus directing the respondents to complete the construction of school building at village-Raipura, Rajoun Block, District-Banka.
A counter affidavit has been filed by the Director,
Patna High Court CWJC No.6481 of 2023(3) dt.25-07-2023 2/3 Primary Education, Education Department, Government of Bihar. Paragraphs 10, 11 and 12 of the counter affidavit read as under:- "10. That it is submitted that the District Education Office, Banka, vide letter no.472 dated 19.07.2023 has submitted an estimate for the construction of the remaining work of the said building duly approved by Junior Engineer/Assistant Engineer for an estimated amount of Rs.19,82,000/-.
11. That it is stated that the aforesaid estimated amount to the tune of Rs.19,82,000/- has been sanctioned vide office order contained in Memo no.06/N 6-32/2023 105 dated 21.07.2023.
12. That it is humbly stated that the department will take all endeavor to complete the construction of the school in question without any delay." In view of the aforementioned statements made in the counter affidavit, learned counsel for the petitioner submits that this writ application may be disposed of with a direction to the respondents to abide by their statements and complete the construction of the school building within a reasonable time. Learned counsel for the State submits that in paragraph '12' of the counter affidavit, the Director, Primary Education has already made a statement that the department will take all endeavour to complete the construction of the school in question without any delay.
Patna High Court CWJC No.6481 of 2023(3) dt.25-07-2023 3/3 Having regard to the kind of submissions and the stand of the Department, this Court is disposing of the present writ application with a direction to the respondents to abide by the statements made in the counter affidavit and complete the construction of the school in question as early as possible preferably within a period of nine months from today.
