The petitioner seeks bail in connection with Lalganj P.S. Case No. 58 of 2020, dated 20.02.2020, instituted for the offences under Sections 20, 22, 23, 24, 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 25(1-B)a, 26 and 35 of the Arms Act. According to the prosecution case, two persons
Patna High Court CR. MISC. No.26968 of 2020(2) dt.19-10-2020 2/3 were arrested with narcotics and firearm weapons. One person is said to have escaped from the clutches of the police. The arrested accused person, viz., Bittu Kumar, disclosed before the police that the person who had managed to escape was none else, but the petitioner and he was also in possession of narcotics.
Learned counsel for the petitioner has submitted that except for the aforesaid statement, there is no other material to connect the petitioner with the offence. The petitioner was arrested after two months of the occurrence from his residence and there was no recovery of any incriminating article or narcotic substance from his possession.
The reason assigned in the bail application for aforesaid Bittu Kumar to have named the petitioner is that the petitioner had solemnized marriage with a woman with whom Bittu Kumar wanted to get married.
In any view of the matter, regard being had to the nature of accusation against the petitioner and his period of custody which is from 04.04.2020 and also taking note of

No.26968 of 2020(2) dt.19-10-2020 3/3 the fact that he is a person clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge-Cum-Special Judge, Vaishali in connection with Lalganj P.S. Case No. 58 of 2020.
The application stands allowed.
