====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-01-2022 Heard Mr. Kumar Goutam, learned Advocate for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek bail in anticipation of their arrest in connection with Pipra P. S. Case No. 97 of 2020 instituted for the offences under Sections 341, 323, 325, 354, 307, 504 and 506/34 of the Indian Penal Code.
Though the petitioners have been named in the F.I.R. with general and omnibus allegation, but the actual assault has been attributed to one Dinesh Mandal. Though some of the
Patna High Court CR. MISC. No.33991 of 2021(2) dt.20-01-2022 2/2 persons have been injured in the occurrence, but the petitioner no.1 has also filed a counter version of the occurrence in which the informant of the present case has been made accused. There is no specific accusation against the petitioners and there is a land dispute between the parties. Regard being had to the afore-stated facts and taking into account the gender of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Supaul in connection with Pipra P.S. Case No. 97 of 2020, subject to the condition as laid down under Section 438 (2) Cr. P.C.
The application stands allowed.
