JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Chainpur P.S. Case No. 319 of 2017, dated 03.12.2017, instituted for the offences punishable under Sections 414, 467, 468 and 34 of the Indian Penal Code.
During the course of regular checking on road, one Kamlesh Kumar was arrested with a motorcycle, who could not produce relevant papers regarding its possession. On being interrogated, the aforesaid Kamlesh Kumar is said to have told the police party that the vehicle was a
Patna High Court Cr.Misc. No.16014 of 2018 (2) dt.09-04-2018 2/2 stolen one and it was given to him by the petitioner for the purposes of selling it in the market.
Learned counsel for the petitioner has submitted that but for such a statement having been made by an apprehended accused person, there is no other material to connect the petitioner with the crime. That apart, he has submitted that no case, so far his knowledge is concerned, has been registered in connection with theft of the aforesaid motorcycle and the petitioner has clean antecedent.
Regard being had to the aforesaid facts, let the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 319 of 2017.
