This application for anticipatory bail arises out of Basopatti Police Station Case No. 187 of 2017 for the offence punishable under Sections 467, 468, 471 and 420 of the Indian Penal Code.
The matter relates to appointments against the post of Panchayat Teacher, allegedly based on a forged and fabricated merit list. At the relevant point of time, the petitioners were members of the Panchayat Niyojan Samiti, responsible for preparing the merit list.
Learned counsel appearing on behalf of the petitioners has submitted that the Chairman of the Committee,
Patna High Court CR. MISC. No.26024 of 2019(2) dt.22-04-2019 2/2 Smt. Hira Devi and Panchayat Secretary, Vishnu Deo Bhandari, have been allowed anticipatory bail by this Court by order, dated 17.04.2019, passed in Criminal Misc. No. 23937 of 2019 and order, dated 15.04.2019 passed in Criminal Misc. No. 23659 of 2019 respectively.
Considering the above, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- V, Madhubani, in Basopatti Police Station Case No. 187 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
