In this case, the petitioners are apprehending their arrest in connection with Barh P.S. Case No. 124 of 2017 registered for offences under sections 341, 323, 324, 307, 376 and 420/34 of the Indian Penal Code.
The petitioner no.1 is the mother and petitioner no.2 is the brother of accused Shishir Kumar who is posted as Income Tax Inspector at Surat (Gujrat). Shishir Kumar has been made the main accused in the present case. An allegation has been made against the accused Shishir Kumar that he has assured the Informant for marriage and, for five years, he has established
Patna High Court Cr.Misc. No.33807 of 2017 (2) dt.27-07-2017 physical relationship with her. When Shishir Kumar has entered into marriage with another lady, she came to Patna where she was confined in a room and was assaulted badly.
Learned counsel for the petitioners submits that the present petitioners have nothing to do with the offence committed by Shishir Kumar.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Meena Sinha and Saris Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 124 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
