This application, for grant of anticipatory bail, arises out of Kothi Police Station Case No. 32 of 2018, disclosing offences under Sections 498A/304B/201/120B/34 of the Indian Penal Code.
Learned Counsel appearing on behalf of the petitioners has submitted that the petitioners are brothers of the husband of the deceased. He contends that they have been implicated only because they are family members. He also submits that father-in-law and mother-in-law of the deceased
Patna High Court CR. MISC. No.23804 of 2019(2) dt.12-04-2019 2/2 have been allowed anticipatory bail by this Court by order, dated 05.01.2019, passed in Criminal Misc. No. 1848 of 2019. Considering the above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Kothi Police Station Case No. 32 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
