The petitioner filed this petition for modification of the order dated 15.09.2015 passed in Cr. Misc. No. 29661 of 2015 by which the petitioner was granted regular bail for six months. The petitioner was directed to return the money to the informant and if the petitioner fails to deposit the agreed amount to the informant the bail bonds of the petitioner shall be cancelled. This petition is filed for modification to operate the bank account which was closed by the Court. It has been submitted that the petitioner has already returned the entire amount to the informant. Shri Mukul Prasad, learned counsel for the informant submits that two cheques are yet to be encashed. Shri Mukul Prasad, learned counsel for the informant further

Patna High Court Cr.Misc. No.53289 of 2015 (4) dt.18-05-2016 2/2 submits that he will file a petition for de-freezing the account of the informant and on such the learned court below is directed to pass order of de-freezing the account of the informant so that the cheques of the petitioner can be encashed in favour of the informant.

Since the entire money has already been given to the informant, this petition has become infructuous. Accordingly, provisional bail granted to the petitioner in Rupaspur P.S. Case No. 68 of 2015 to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur is hereby confirmed and the petitioner is allowed to remain on the same bail bonds. Shri Mukul Prasad, learned counsel for the informant who filed I.A. No. 877 of 2016, seeks permission to withdraw the same.

The I.A. No. 877 of 2016 is dismissed as withdrawn. Accordingly, this modification petition is disposed of. (Prabhat Kumar Jha, J.) KKSINHA/- U T
