JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Earlier prayer for bail of the petitioner was rejected vide order dated 06.10.2018 passed in Cr. Misc. No. 60498 of 2018 with a direction to the learned trial Court to expedite the trial.

The petitioner seeks regular bail in connection with S. Tr. No. 466 of 2017 arising out of Baliya P.S. Case No. 110 of 2017, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 307, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of firing on the aunt of the informant, who later on succumbed to the injury. Submission of learned counsel for the petitioner is that uptil now four witnesses have been examined in this case and three of them are eye witnesses, but they have not supported

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation and several witnesses are still to be examined, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial.

Accordingly, this application is dismissed.
