This application, for grant of anticipatory bail, arises out of Giriyak P.S. Case No. 140/2017, disclosing offences under Sections 341, 323, 353, 506 & 379/34 of the Indian Penal Code. The prosecution case is that co-accused Manoj Kumar Sharma was consuming electricity during the period of disconnection of electric line.
Allegedly, when the staff of South Bihar Power Supply Company had gone to inspect the premises, the said accused Manoj Kumar Sharma and the present petitioner assaulted the staff of the said Company.
Patna High Court Cr.Misc. No.43399 of 2017 (3) dt.03-10-2017 2/2 Considering the nature of accusation, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Nalanda at Biharsharif in connection with Giriyak P.S. Case No. 140/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
