JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 420 and 406 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that as he is only Sales Representative and nothing to do with collection of amount, however as he had, he has been falsely implicated in this case. It has also been stated that there is delay in lodging the F.I.R. for two months.
Heard learned A.P.P. also.
Having heard both sides and in the facts and circumstances of the case and as there is direct allegation against petitioner, I am not inclined to grant anticipatory bail to the
Patna High Court Cr.Misc. No.53903 of 2016 (2) dt.12-01-2017 2/2 petitioner.
However, petitioner may surrender in the court below, i.e., Addl. Chief Judicial Magistrate, Siwan, in connection with Siwan Town P. S. Case no. 495 of 2013 and make prayer for bail which will be considered on its own merit without being prejudiced by this order.
With the observation/direction aforesaid this application is dismissed.
