The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 47 of the Bihar Excise (Amendment) Act.

About eight litres illicit country made liquor was, allegedly, recovered from the possession of this petitioner on 13.09.2016. Petitioner has stated on oath that he has got no criminal antecedent. Further submission is that false implication is there at the hands of enemies of the petitioner. Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.53152 of 2016 (2) dt.08-12-2016 of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Chapra/Successor Court in connection with Parsa Police Station Case No. 170 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as the condition that the petitioner would file affidavit before the court below that he would not indulge in such activity in future.
