The petitioner apprehends his arrest in connection with Bhagalpur G.R.P.S. Case no. 121 of 2017 registered for the offences punishable under Sections 401, 328 of the Indian Penal Code.

Allegedly, the informant who is a Police officer with the help of other Police personnel caught Arbind Singh and from his possession several intoxicating articles were recovered and he disclosed the name of the petitioner and others who succeeded in fleeing away.

Submission is of false implication and that nothing has been recovered from possession of the petitioner or from his

No.44091 of 2017(2) dt.19-09-2017 2/2 house and the petitioner has been named by co-accused due to enmity and the petitioner has got no criminal antecedent and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway, Bhagalpur in connection with Bhagalpur G.R.P.S. Case No. 121 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
