The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, while the informant was returning along with his mother after withdrawing cash from the Bank, it is stated that two unknown accused persons snatched the bag containing cash as a result of which his mother fell down and injured herself. The accused escaped. It is submitted by learned senior counsel appearing for the petitioner that the FIR was registered against unknown. The petitioner has been falsely implicated in the case in course of

Patna High Court CR. MISC. No.26159 of 2022(3) dt.13-01-2023 2/2 investigation, when allegedly, some of the looted money was recovered from his possession. Neither the alleged amount recovered nor the petitioner has been put on T.I. parade. The petitioner is in custody since 22.11.2021 and charges have been framed in the learned trial court.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody for more than 1 year since 22.11.2021, chargesheet having been submitted without putting the petitioner on T.I. parade and charges having been framed in the learned trial court, the petitioner is directed to be enlarged on bail in connection with Hajipur Town P.S. Case no. 661 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
