JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Baheri P.S. case No. 107 of 2016 registered for the offence punishable under sections 365, 366/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the present first information report has been lodged after 13-14 days of the alleged occurrence, without any explanation. As a matter of fact, the victim had taken a room in the house of the petitioner on rent and her relatives used to visit there frequently and her cousin brother forcibly established physical relationship, she narrated her pathetic condition to this petitioner and requested to become a witness in the case to be filed by her. Victim thereafter filed Complaint Case No. 811 of 2016, as

Patna High Court Cr.Misc. No.44723 of 2017(3) dt.12-10-2017 2/2 contained in Annexure-2 in which petitioner is a witness. There is nothing in the complaint to suggest that the victim was abducted by this petitioner. The allegations levelled are false and concocted.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Darbhanga in connection with Baheri P.S. Case No. 107 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
