In this case, the petitioners are apprehending their arrest in connection with Daudnagar P.S. Case No. 66 of 2019 registered for offences under sections 341, 323, 307, 379/34 of the Indian Penal Code.

As per F.I.R., there is a specific allegation of assault against the petitioner no.1, Ranjan Sharma and with respect to petitioner no.2 & 3, namely, Laldo Sharma and Ankit Kumar, there is no direct allegation of assault and against the petitioner no.4, namely, Ayush Kumar, the allegation is of taking away Rs. 5,000/-.

Patna High Court CR. MISC. No.24224 of 2019(2) dt.16-04-2019 2/2 As there is a specific allegation against the petitioner no.1, Ranjan Sharma, this Court is not inclined to grant privilege of anticipatory bail to him.

Accordingly, the prayer for anticipatory bail of the petitioner no.1, above named, is rejected.

There being no specific allegation against the petitioner nos. 2, 3 & 4 as also looking to the entire facts and circumstances of the case, let the petitioner nos. 2, 3 & 4, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Daudnagar P.S. Case No. 66 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call them for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
