ANSHUMAN ORAL ORDER 12-09-2022 Learned counsel for the petitioner submits that due to inadvertence, mistake of date has taken place on para 3 of the present petition. He requested to remove the defect. Permission is granted in course of the day.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Muffasil P.S. Case No. 231 of 2021 lodged under Sections 302 and 34 of the I.P.C.
As per the prosecution case, there is specific allegation against this petitioner who assault the mother of the informant by iron rod, in result she died.
Learned counsel for the petitioner further submits that petitioner is in custody since 09.08.2021, charge sheet has
Patna High Court CR. MISC. No.26890 of 2022(2) dt.12-09-2022 2/2 already been filed in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner, therefore, his bail petition is hereby rejected. The petitioner may renew his prayer for bail one year after framing of charge and trial court will release him on bail upon conditions.
With this observation, the bail application stands rejected.
