JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-10-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Jankinagar Police Station Case No. 11 of 2021 registered for the offences punishable under sections 302/201/120B/34 of the Indian Penal Code.

As per the prosecution case, informant's sister was married to the petitioner 8/9 years back and for past few years petitioner used to beat the victim. On 18.1.2021 he got information that the victim has been killed. Thereafter he went to her matrimonial house but he did not find the dead body. He came to know that the accused persons killed her on 17.1.2021 and threw the dead body in JBC canal.

Learned counsel for the petitioner submits that in fact

No.33478 of 2021(4) dt.28-10-2021 2/2 sister of the informant died of stomach pain and the petitioner is innocent and has been implicated in the case only because of being husband of the deceased. Petitioner has been implicated in this case only on suspicion. Petitioner is in custody since 19.1.2021.

Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation that the petitioner in league with his family members killed his wife in a planned conspiracy. Dead body of the victim is still traceless. In view of the specific allegation against the petitioner as well as the fact that the informant's daughter died under unnatural circumstance and the petitioner is the husband of the deceased whose dead body is still traceless, his prayer for bail is refused.
