Petitioner seeks regular bail in connection with Narayanpur PS Case No. 85/2019 registered for the offence punishable under Sections 302/307/34 of the IPC and Section 27 of the Arms Act.

As per First Information Report, six named accused persons along with some unknown persons arrived at the shop of the informant and resorted to indiscriminate firing due to which brother of the informant and one customer sustained bullet injury and subsequently, brother of the informant succumbed to the injuries.

No.35106 of 2021(3) dt.21-03-2022 2/3 Learned counsel for the petitioner submits that the petitioner is not named in the FIR and from perusal of the FIR, it would be evident that the specific allegation of firing is upon Vikas Kumar and Hareram Singh. He next submits that the name of the petitioner has been disclosed by the arrested coaccused, Vikas Kumar and except the confessional statement of co-accused, Vikas Kumar, there is no material against the petitioner. He further submits that the named accused persons, namely, Satyendra Singh and Vicky Kumar have been granted bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 29114/2020. Learned counsel also submits that petitioner having no criminal antecedent is in custody since 01.02.2021 and the charge-sheet, in the matter, has also been submitted.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated co-accused persons have been granted bail by a Co-ordinate Bench of this Court, petitioner having no criminal antecedent is in custody since 01.02.2021 and the charge-sheet, in the matter, has also been submitted, I am inclined to grant regular bail to the petitioner.

Patna High Court CR. MISC. No.35106 of 2021(3) dt.21-03-2022 3/3 bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Narayanpur PS Case No. 85/2019.
