The petitioner is apprehending his arrest in connection with Pirpainty P.S.Case No. 238 of 2015 registered for the offences punishable under Sections 394 and 411 of the Indian Penal Code.

Petitioner is not named in the FIR and it appears that he has been named by co-accused person.

It has been submitted on behalf of the petitioner that parentage of the petitioner does not tally with the name given in the charge-sheet. However, charge-sheet has been submitted against him and he has no criminal antecedent. It has further been submitted that nothing has been recovered from the possession of the petitioner.

Heard learned APP also.

Patna High Court Cr.Misc. No.33618 of 2017 (2) dt.20-07-2017 2/2 Having heard both sides and in view of above facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.

Let the petitioner, named above, surrender in the court below and pray for regular bail, which will be considered on the basis of the submission made above and disposed of on the same day, if possible.
