JUSTICE SANJAY PRIYA ORAL ORDER 4/ 09-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Runnisaidpur P.S. Case No.770 of 2018 instituted for the offence under Section(s) 302, 120-B/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that mere suspicion has been raised against the petitioner in the First Information Report. There is no eye witness to the occurrence. Case dairy has been received. Learned APP as well as counsel for the informant has submitted that the witnesses in different paragraphs have stated that son of the informant had gone with this petitioner. Both were working together in AIRTEL.

Patna High Court CR. MISC. No.24518 of 2019(4) dt.09-07-2019 2/2 It is alleged that the informant received information in the night from co-villager that his son has been killed in village Manpur. The informant along with other villagers went to Manpur village and found dead body of his son lying. Informant has raised suspicion against this petitioner. The petitioner had money dispute with deceased son of the informant. From the impugned order of the Sessions Judge, it appears that there is no eye witness to the occurrence. There is no specific allegation of overt act against the petitioner. Petitioner is in custody since 01.01.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No.770 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
