Petitioner apprehends his arrest in Jadopur P.S. case no. 72 of 2017 instituted for the offence under Section(s) 341, 323, 324, 325, 307 and 504/34 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code is added. Learned counsel for the petitioner has submitted that there is allegation against this petitioner that he assaulted the brother of the informant, namely Prabhu Nath Prasad on both the hands causing fracture injury. Learned counsel for the petitioner has submitted that the case diary has been received wherein the injury report of Prabhu Nath Prasad is available. Learned counsel(s) for the informant and State have appeared and opposed the prayer.

Patna High Court Cr.Misc. No.2448 of 2018(3) dt.15-02-2018 2/2 Learned Court for the State after looking into the case diary has submitted that the doctor has found fracture injury on the arm of the injured Prabhu Nath Prasad which is opined to be grievous in nature. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
