JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Pirpainti P.S. Case No. 29 of 2016 registered under sections 341, 342, 323, 324 and 307/34 of the Indian Penal Code and section 27 of the Arms Act. Allegation is that in the night, the informant was intercepted by accused persons including the petitioner and one co-accused Kalan Ansari shot at the son of the informant causing fire arm injury. It is alleged that this petitioner assaulted with fist. Considering the nature of fire arm injury to the son of the informant and involvement of the petitioner in the occurrence, it is not a fit case for grant of anticipatory bail. So, the prayer is rejected. However, the petitioner, if so advised, may surrender before the court below and seek regular bail which shall be considered on merit without being prejudiced by this order.
