The petitioner apprehends his arrest in Beldaur P.S. Case No. 28/2017, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that Sadanand Singh and Dilip Mandal dragged her to bamboo bush and made an attempt to commit rape with her, but the informant some how saved. While the informant and her daughter were going to police station, on the way, Dhiraj Kumar Singh, Ramesh Mandal (Petitoner), Vinodi Mandal and Kailash Mandal intercepted them and Dhiraj Kumar Singh assaulted her with Dabia on her head. All the accused persons also assaulted the informant and her daughter. Learned counsel for the petitioner submits that there

Patna High Court Cr.Misc. No.43926 of 2017 (2) dt.22-09-2017 2/2 is a series of litigations between both sides. The petitioner is not the assailant of the informant. There is no specific allegation of assault against the petitioner. The daughter of the informant did not receive any injury. Sadanand Singh has already been granted anticipatory bail vide order passed in Cr. Misc. No. 25049/2017. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Beldaur P.S. Case No. 28/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
