JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Shyampur Bhatha P.S. Case No. 16 of 2011 registered under Section-406 of the Indian Penal Code.

The name of the petitioner came in this case in confessional statement of co-accused Chandan Kumar Pandey who was caught on the spot and it appears that in course of investigation, almost all the witnesses stated only to this effect that apprehended co-accused disclosed the name of the petitioner. The petitioner does not have any criminal antecedent and except the confessional statement, there appears to be nothing against him. Accordingly, let the petitioner named above, in the

Patna High Court Cr.Misc. No.36153 of 2016 (3) dt.10-11-2016 2/2 event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Shyampur Bhatha P.S. Case No. 16 of 2011 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sheohar subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
