JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2017 This application is for grant of anticipatory bail in connection with Deokund P.S. Case No. 06 of 2017 registered for the offence(s) under section(s) 7 of the Essential Commodities Act. Allegation against the petitioner is of not showing the relevant register to the Sub-Divisional Officer and the Block Supply Officer who inspected the shop of the petitioner. Further allegation against the petitioner is of less supply of food grains and kerosene. Submission of the learned counsel for the petitioner is that there is no complaint against the petitioner. No show cause was issued to him and his license was not cancelled and he is also ready to abide by any conditioning granted anticipatory bail. Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and circumstances, as stated above, this application is allowed.

No.33794 of 2017 (2) dt.20-07-2017 2/2 Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Deokund P.S. Case No. 06 of 2017, subject to the condition as laid down under Section 438 (2) Cr. P.C. Further subject to the condition that the petitioner shall cooperate in the investigation of the case and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive occasions, his bail bond shall be liable to be cancelled.
