Petitioner is seeking anticipatory bail in Asthawan P.S. Case No. 238 of 2017 for the offences registered under Sections 341, 323, 379, 307, 448, 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that this petitioner has been falsely implicated in the present case, both the parties are own Gotias and admittedly they had fought over certain petty issues. As per the allegation, this petitioner had assaulted the informant by brick but, in the latter part of the Fardbeyan, the informant has not attributed any injury due to said brick assault. Learned counsel further submits that the alleged occurrence was reported to police belatedly and the husband of the petitioner is
Patna High Court Cr.Misc. No.6853 of 2018 (2) dt.17-02-2018 2/2 already in jail.
Learned counsel for the State is present.
Considering the facts and circumstances, particularly that this petitioner is a lady and the allegation against her has not been further substantiated, for the present I am inclined to grant anticipatory bail to the petitioner. In case of her arrest or surrender in the learned court below within four weeks from today, the petitioner, named above, is directed to be released on bail on her furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VI, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 238 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
