JUSTICE SANJAY KUMAR ORAL ORDER 31-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The present application has been filed to quash the order dated 29th March 2011 passed by the learned Chief Judicial Magistrate, Khagaria in Complaint Case No. 307(C)/2008 whereby and whereunder cognizance for the offence under section 504 of the Indian Penal Code was taken against the opposite party no. 2.
The petitioner filed a criminal revision application before the Sessions Court praying therein to interfere with the order of cognizance and order for taking cognizance in other
Patna High Court Cr.Misc. No.36122 of 2014 (4) dt.31-10-2017 2/2 sections also, which was dismissed by the learned Sessions Judge. The learned counsel for the petitioner has produced a copy of order dated 17.05.2017 passed in Criminal Miscellaneous No. 38281 of 2011, which was filed by the opposite party no. 2 and the said cognizance order has been quashed by one of the coordinate Bench of this Court In the facts and circumstances of the case, this criminal miscellaneous application is of no use, as the cognizance order has been quashed.
