====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Alam Nagar P.S. Case No. 144 of 2015, registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

On the basis of private complaint lodged by Junior Alam @ Md. Junaid, this case has been lodged. The allegation against the petitioners is that the petitioner nos. 1 and 3 were granted funds for construction of Indira Awas Scheem but they misappropriated the same and petitioner nos. 2 and 4 are the husbands.

Submission is of false implication and that petitioner

Patna High Court Cr.Misc. No.35087 of 2017 (2) dt.10-08-2017 2/2 nos. 1 and 3 have been allotted the funds under Indira Awas Scheme and they have already deposited the money in the Nazarat. The petitioner nos. 2 and 4 have got no concerned and they have been unnecessarily implicated, there is no legal and tangible material against the petitioners and, as such, the petitioners deserve sympathetic consideration.

The learned A.P.P. submits that the petitioners have alleged in para 10 of the bail petition, that they have already deposited the money in the Nazarat of Alam Nagar Block on the order of B.D.O.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Uda-Kishunganj, in connection with Alam Nagar P.S. Case No. 144 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
