====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bahadurpur P.S. Case No.307 of 2018/Special Case No.9967 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of 105 pouches, each containing 200 ml. country made liquor, from the room of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is accused in four other cases of similar nature, as detailed in paragraph-3 to this application, due to that reason, he has falsely been implicated in this case by

Patna High Court CR. MISC. No.23360 of 2019(2) dt.11-04-2019 2/2 the police. The petitioner was not apprehended on the spot. The petitioner has been remanded in this case on 18.02.2019 and since then he is in custody.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge (Excise), Patna, in connection with Bahadurpur P.S. Case No.307 of 2018/Special Case No.9967 of 2018.
