2. Despite repeated calls, none appears on behalf of the appellant, whereas Mr. Satya Narayan Prasad, learned, Additional Public Prosecutor for the State is present.

3. Perusal of record shows that vide letter dated 21.12.2023 of Assistant Registrar, Criminal Appeal Section of this Court, a living status report of accused appellant was called for. In response thereto, the Superintendent of Police, Buxar submitted a report dated 18.01.2024 based on the information furnished by the Assistant S.H.O., Dumraon P.S. apprising this

Patna High Court CR. APP (DB) No.325 of 1996(11) dt.15-12-2025 2/2 Court that the sole appellant namely, Dasrath Yadav has died on 26.04.2017 during pendency of this Criminal Appeal. The Death Certificate dated 06.05.2017 issued by the Registrar (Birth and Death), Nagar Parishad, Dumraon is also enclosed along with the said report.

4. In view of the above, the instant Criminal Appeal filed by appellant Dasrath Yadav stands abated.
