The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468, 471, 323 and 120(B) of the Indian Penal Code. Co-accused Ajay Kumar @ Pintu is Sarhu of the complainant. He and his father demanded Rs.1,50,000/- for the marriage of the daughter. They provided a bank account wherein the complainant was to provide the money. The bank account is of the petitioner.
Learned counsel for the petitioner submits that the petitioner has stated on oath in paragraph 10 of the bail petition that his name is only Ravi Raj Singh and not Shashi Raj Singh. Shashi Raj Singh is full-brother of the petitioner. However, by
Patna High Court Cr.Misc. No.52995 of 2016 (2) dt.21-12-2016 2/2 adding name of the brother of the petitioner, as allies name of the petitioner, the complainant wants to harass the brother of the petitioner also.
The aforesaid fact makes it clear that Shashi Raj Singh is not an accused in this case.
Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah/Successor Court in connection with Hisua Police Station Case No. 152 of 2014 arising out of Complaint Case No. 839 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
