JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Complaint Case No. 3211C of 2015 (T.R. No. 969 of 2015) for the offences instituted under Sections 323, 420, 471 and 504 of the Indian Penal Code.
The allegation against the accused persons including the petitioner is of introducing themselves as the Directors of a Firm and took heavy amount from unemployed persons in the name of sending them to foreign country.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

No.54363 of 2016 (2) dt.21-12-2016 2/2 Complainant had preferred the present Complaint case on 07.11.2015 and he had made an application before the Superintendent of Police, Motihari dated 26.12.2015. The matter was referred for enquiry by the Superintendent of Police, Motihari. The Enquiry Report is Annexure-4 to the present application. The allegations made by the Complainant were found to be false.
On behalf of the State, it has been submitted that the petitioner is named in the Complaint Case Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 3211C of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.=IV, Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
