JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 21.11.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with a case registered under sections 420, 120B of the Indian Penal Code, sections 63, 65 of the Copy Right Act and sections 103, 104 of the Trade Mark Act.

Informant happens to be vigilance officer in Dabur company and he claims that in presence of police some duplicate items of the aforesaid company were seized from the shop of the petitioner but submission on behalf of the petitioner is that nothing was seized from the shop of the petitioner and, as a matter of fact, petitioner has been implicated in this case on account of enmity and political rivalry. To fortify his contention, he submits that seizure list was not prepared by the police official rather seizure list goes to show that same was

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Katihar Town (Sahayak) P.S. Case no. 484/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
