2. The petitioner apprehends his arrest in connection with Phulwarisharif P.S. Case No. 298 of 2024 registered under Sections 147, 148, 149, 447, 307, 387, 427, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is alleged that petitioner along with other accused persons equipped with weapons demolished the boundary wall of the informant and also threatened him with dire consequences.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to land dispute. Further submission is that there is general and omnibus allegation
Patna High Court CR. MISC. No.28256 of 2024(2) dt.30-04-2024 2/2 against the petitioner. It is submitted that no person has received any injury in the alleged occurrence and hence, no offence is made out under Section 307 of I.P.C.
5. Learned counsel for the Informant opposes the prayer for bail.
6. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIV, Patna in connection with Phulwarisharif P.S. Case No. 298 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
