2. The petitioner is apprehending arrest in connection with Basantpur P.S. Case No. 485 of 2025 instituted under Sections 103, 238 & 61(2) of B.N.S., 2023 lodged on 20.08.2025 by the informant, Rima Devi.

3. As per the prosecution story, the informant alleged that her son, Piyush Kumar Singh went out but failed to return. Later, information came that near Gandak Canal, a half burnt dead body is lying. When they went to the place, found injuries on the neck and the body was burnt with petrol. This led to the FIR.

4. Subsequently, investigation took the police to Aman Kumar Singh who spilled the beans, according to which

The allegation is that Himanshu Singh caught hold of Piyush whereafter, Aman Kumar Singh gave knife blow on the neck. This was followed by the knife injuries by Anish and Suraj Pandey. Later, allegation against this petitioner is of sprinkling petrol on the body and put it on fire. The knives and the phone were thrown in the canal and later, accused changed clothes by purchasing it from the market.

Though, learned counsel for the petitioner tried to impress upon this Court about his innocence, learned APP Mr. Jitendra Kumar Singh submits that the petitioner has played an important role as allegation is that after the blow on the neck, he made it sure that the victim dies by sprinkling petrol and putting it on fire.

6. Considering the aforesaid facts, allegation that has come against the petitioner, no case of anticipatory bail is made out. It is accordingly, rejected.
