The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Singheshwar P.S. Case no. 167 of 2021 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 325, 307, 427, 384 of the Indian Penal Code and section 27 of Arms Act. It is a case of assaulting to the informant's father-inlaw and brother-in-law by the petitioner along with three other accused persons due to which they sustained injury. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to land dispute between the parties. He has got no criminal antecedent.

No.27594 of 2022(3) dt.22-11-2022 2/2 It is further submitted that after perusal of case diary the petitioner is only order giver and he has not inflicted injury to the injured persons. It is further alleged that there is general and omnibus allegation against the petitioner not specific overt-act against him.

Learned APP appearing for the state has opposed the prayer of anticipatory bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Singheshwar P.S. Case no. 167 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura subject to the conditions as laid down under section 438(2) of the Cr.P.C.
