1. Learned counsel for the petitioner submits that petitioner's services are not being regularized on the post of Lecturer in Sociology subject, who was appointed temporarily on 21.03.1994 in the College in question in Labour and Social Welfare Department (now Sociology) in view of the letter no. 406 dated 27.07.2011 of the Department of Human Resources Development, Bihar, Patna.

2. Learned counsel for the respondent no. 6 as well as learned counsel appearing for the Bihar School Examination

Patna High Court CWJC No.18293 of 2015(7) dt.23-07-2024 2/2 Board submit that the dispute can be decided by the District Appellate Authority which is still functional. The petitioner has directly approached this Court without availing the remedy before the District Appellate Authority.

In view of the nature of dispute, the present writ application is disposed with liberty to the petitioner to file Appeal within one month from today before the District Appellate Authority under Rule 13(C) of the Bihar State Teaching Institutions Teachers and Employees (Disputes Redressal and Appeal) Rules, 2020.

4. It is made clear that if any Appeal is filed by the petitioner, the District Appellate Authority shall dispose the same in accordance with law expeditiously, preferably within a period of six months from the date of filing of the Appeal. (Anil Kumar Sinha, J) praful/- U
